Terms of Service

By accessing and using USTRN, you confirm that you are duly authorized to represent your business entity (whether as a Generator, Hauler, or Processor) and that your entity agrees to comply with these Terms. USTRN is intended for use by businesses and professionals operating in the used tire management and recycling industry.

Under no circumstances shall USTRN, its officers, directors, employees, or agents be liable for any direct, indirect, special, incidental, or consequential damages — including but not limited to loss of data, revenue, or operational disruption — arising from your use of or inability to use the Platform, even if USTRN has been advised of the possibility of such damages.

USTRN reserves the right to change pricing, feature availability, and resource usage policies at any time, with reasonable notice provided to registered users.

To ensure clarity, the following terms are defined as used throughout these Terms:

• Agreement:These Terms of Service, together with the Privacy Policy and any supplemental terms or policies published by USTRN, form the complete agreement between you and USTRN.
• Company / We / Us / Our:United States Tire Recycling Network (USTRN), the provider of the Platform and all related services.
• Platform:The USTRN website, mobile application, APIs, and all associated features and services used to digitize the lifecycle management of used tires.
• Generator:A business entity (e.g., tire shop, auto center) that produces used tires and initiates pickups through the Platform.
• Hauler:A transportation provider registered on the Platform to collect used tires from Generators and deliver them to Processors.
• Processor:A recycling or processing facility registered on the Platform that receives and processes used tires.
• Trip:A logged event within the Platform representing the pickup, transport, and delivery of tires from a Generator to a Processor.
• Receipt:A digital document generated by the Platform recording the details of a completed Trip, including tire counts, types, volumes, timestamps, and participating parties.
• User / You:Any individual or business entity registered to use the Platform, including Generators, Haulers, and Processors.
• Content:Any data, text, records, files, or information submitted to or generated through the Platform.

USTRN grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for your internal business operations related to tire recycling and chain-of-custody management, in accordance with these Terms.

This license does not include the right to sublicense, resell, distribute, or commercially exploit the Platform or any portion of it. All rights not expressly granted herein are reserved by USTRN. If you violate any of these Terms, USTRN reserves the right to terminate your license and account without notice.

To use the Platform, you must register for an account and provide accurate, complete, and current information about your business. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account, whether authorized or unauthorized
• Ensuring that all users who access the Platform under your account comply with these Terms
• Promptly notifying USTRN of any unauthorized access or security breach at support@ustrn.org

USTRN is not liable for any loss or damage arising from your failure to maintain the security of your account.

You agree to use the Platform only for lawful purposes and in compliance with all applicable local, state, and federal laws and regulations, including those governing tire disposal, environmental compliance, and waste management.

You agree not to, and will not permit others to:

• License, sell, rent, lease, assign, or otherwise commercially exploit the Platform or any part of it
• Modify, reverse engineer, decompile, or attempt to extract the source code of the Platform
• Submit false, misleading, or fraudulent trip data, manifests, or receipts
• Use the Platform to circumvent environmental regulations or facilitate illegal tire disposal practices
• Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure
• Attempt to gain unauthorized access to any USTRN systems, accounts, or data
• Scrape, crawl, or harvest data from the Platform without prior written authorization
• Upload or transmit any malicious code, viruses, or harmful software

Violation of this section may result in immediate account suspension or termination and may expose you to civil and criminal liability.

The USTRN Platform is designed to assist your business in maintaining accurate digital records for tire chain-of-custody and regulatory compliance. However, you remain solely responsible for:

• The accuracy and completeness of all data entered into the Platform
• Ensuring your operations comply with applicable state and federal tire disposal, environmental, and recycling regulations
• Verifying that digital manifests and receipts generated by the Platform meet the requirements of relevant regulatory authorities

USTRN provides tools to facilitate compliance but does not guarantee that use of the Platform will satisfy all legal obligations applicable to your specific jurisdiction or operation type.

The Platform and all of its content, features, and functionality — including but not limited to software, text, graphics, logos, icons, and data models — are the exclusive property of USTRN or its licensors and are protected by applicable intellectual property laws.

You retain ownership of all data and Content you submit through the Platform. By submitting Content, you grant USTRN a worldwide, non-exclusive, royalty-free license to use, store, process, and display such Content solely for the purpose of operating and improving the Platform.

Any feedback, suggestions, or ideas (“Suggestions”) you provide to USTRN regarding the Platform shall become the sole property of USTRN. We may use Suggestions without any obligation to compensate or credit you.

The Platform may integrate with or link to third-party services, tools, or websites (e.g., mapping providers, cloud infrastructure, analytics). USTRN is not responsible for the accuracy, availability, security practices, or content of any third-party services.

Your use of third-party services is solely at your own risk and subject to the terms and conditions of those third parties. We encourage you to review third-party privacy policies before using any linked services.

Access to certain features of the Platform may be subject to a subscription plan or usage-based fees. Details of applicable pricing will be communicated to you during account setup or upon access to premium features.

All fees are non-refundable except where required by applicable law or at USTRN's sole discretion. If you believe a billing error has occurred, please contact us within 30 days of the charge at support@ustrn.org. We will review all billing disputes in good faith.

USTRN reserves the right to modify, update, suspend, or discontinue — temporarily or permanently — any aspect of the Platform at any time with or without notice. This includes the right to alter, remove, or add features, change pricing, or restrict access to certain functionalities.

USTRN may from time to time release updates, patches, or enhancements to the Platform. All such updates shall be deemed an integral part of the Platform and subject to these Terms. USTRN has no obligation to provide any specific updates or to maintain any particular feature indefinitely.

These Terms remain in effect for as long as you use the Platform or maintain an active account.

USTRN may, at its sole discretion and at any time, suspend or terminate your access to the Platform with or without prior notice if:

• You breach any provision of these Terms
• You submit fraudulent or materially inaccurate trip data or manifests
• Your account is used in violation of applicable law or regulation
• USTRN discontinues the Platform or any part of it

You may terminate your account at any time by contacting us at support@ustrn.org. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, USTRN DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

USTRN does not warrant that the Platform will be uninterrupted, error-free, fully secure, or free of viruses or other harmful components. You use the Platform at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL USTRN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

USTRN's total cumulative liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the greater of (a) the amount you paid USTRN in the twelve (12) months immediately preceding the claim, or (b) one hundred dollars ($100).

You agree to indemnify, defend, and hold harmless USTRN and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Platform
• Your violation of these Terms
• Your breach of any applicable laws or regulations
• Any Content you submit that is false, misleading, or unlawful

These Terms shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which USTRN is headquartered, without regard to conflict of law principles.

Before initiating any formal legal proceedings, you agree to first contact USTRN at support@ustrn.org and provide a written description of the dispute. Both parties agree to attempt to resolve any disputes in good faith within 30 days.

Any unresolved disputes shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). YOU AND USTRN AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PLATFORM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

USTRN's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term.

USTRN reserves the right to update or modify these Terms at any time. When we make material changes, we will notify registered users via email or a prominent notice on the Platform and update the “Last Updated” date above. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

These Terms, together with our Privacy Policy and any other legal notices or supplemental terms published by USTRN, constitute the entire agreement between you and USTRN with respect to the Platform and supersede all prior or contemporaneous communications, agreements, and understandings.
